These Terms of Use (the “Terms”) govern access to and use of the website, webpages, online forms, and other digital features operated by or on behalf of WA Management & Consulting (“WA MAC,” “we,” “us,” or “our”) that link to these Terms (collectively, the “Website”).

Please read these Terms carefully. By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. About WA MAC and the Website

WA MAC provides property management, home management, landlord support, tenant coordination, maintenance and vendor coordination, project oversight, property inspections, consultations, and related services.

The Website provides general information about WA MAC and its services and may allow users to view property information, submit inquiries, request consultations, begin applications, access links to third-party portals, or communicate with us.

The Website itself does not create a property-management, landlord-tenant, brokerage, vendor, contractor, fiduciary, or other professional relationship. Services are provided only under the applicable written agreement, lease, work order, approved estimate, engagement confirmation, or other governing document (each, a “Service Agreement”). If these Terms conflict with a Service Agreement, the Service Agreement controls with respect to the services or relationship it governs.

2. Eligibility and Authority

You may use the Website only if you are legally capable of agreeing to these Terms. If you use the Website for a company, trust, partnership, property owner, or other person or entity, you represent that you are authorized to act for that person or entity with respect to your Website activity.

The Website is not directed to children under 13. Information concerning minors that is relevant to an application, authorized occupancy, emergency contact, or property relationship should be provided only by an authorized adult through the appropriate process.

3. Informational Purposes; No Offer or Guarantee

Website content is provided for general informational purposes. Content may describe services, properties, availability, features, pricing, estimated costs, schedules, processes, or legal and operational topics. Unless WA MAC expressly states otherwise in a binding written document:

  • Website content is not an offer, promise, guarantee, warranty, or professional opinion;
  • an inquiry, consultation request, application, or message does not guarantee acceptance, availability, approval, scheduling, a lease, or services;
  • property availability, pricing, fees, specifications, dimensions, amenities, photographs, policies, and service descriptions may change; and
  • WA MAC may correct errors or update information at any time.

You should independently verify information that is important to your decision before relying on it or entering into an agreement.

4. Property Listings and Rental Information

Property listings and rental information may be provided by property owners, listing services, vendors, public sources, or other third parties. WA MAC seeks to present information accurately but does not warrant that every listing, photograph, floor plan, measurement, map, school assignment, neighborhood description, amenity, price, utility description, availability date, or other property detail is complete, current, or free from error.

Photographs may show a property at an earlier time, may not depict its current condition, and may include furnishings or features that are not included. Measurements and floor plans may be approximate. Maps, travel times, school information, and neighborhood information should be independently verified with the relevant source.

A property remains subject to availability, screening standards, owner approval where applicable, execution of required documents, payment of required amounts, and applicable law. Website publication does not reserve a property or create a right to rent it.

5. Equal Housing Opportunity

WA MAC supports equal housing opportunity and intends to conduct housing-related activities in accordance with applicable federal, state, and local fair-housing and anti-discrimination laws.

Nothing on the Website should be interpreted as expressing a preference, limitation, or discrimination based on a legally protected characteristic. Accommodation or modification requests should be submitted through the contact information or application process designated for the applicable property so the request can be evaluated under applicable law.

6. Applications, Screening, and Leasing

The Website may link to an application or screening process operated by WA MAC or a third-party platform. Submission of an application does not guarantee approval, create a tenancy, reserve a property, or require a property owner or WA MAC to enter into a lease.

Applications may be subject to stated screening criteria, identity verification, legally permitted consumer reports, verification of information, property availability, payment of disclosed charges, and other lawful requirements. A tenancy is created only through a fully executed lease or other legally sufficient agreement.

Information about the collection and handling of applicant and screening information is provided in our Privacy Policy and, where applicable, in additional notices or authorizations presented during the application process.

7. Consultations, Estimates, and Service Inquiries

Submitting an inquiry, booking request, property information, photograph, or consultation request does not create an obligation for WA MAC to accept an engagement or perform services. WA MAC may request additional information and may decline work that is outside its capacity, geographic area, licensing, safety requirements, or business practices.

Any preliminary range, estimate, schedule, recommendation, or description provided through the Website or an initial communication is subject to verification and does not become binding unless included in an applicable Service Agreement, approved estimate, work order, or other written confirmation.

8. Accounts and Third-Party Portals

Certain features, including tenant, owner, applicant, payment, maintenance, or vendor functions, may be provided through a third-party portal or platform. Additional terms and privacy notices presented by that provider may govern your use of its services.

If you create or receive account credentials, you must:

  • provide accurate and current registration information;
  • keep usernames, passwords, access codes, and authentication methods confidential;
  • use only accounts you are authorized to access;
  • promptly notify WA MAC or the platform provider of suspected unauthorized access; and
  • log out of shared or publicly accessible devices.

You are responsible for activity conducted through your credentials to the extent permitted by law. WA MAC may restrict or suspend Website or portal access when reasonably necessary to protect security, investigate misuse, comply with law, or administer the relevant relationship.

9. User Submissions and Communications

The Website may allow you to submit forms, messages, applications, maintenance requests, photographs, documents, reviews, or other materials (collectively, “User Submissions”). You retain any ownership rights you hold in your User Submissions.

By providing a User Submission, you represent that:

  • the information is accurate to the best of your knowledge;
  • you are authorized to provide it;
  • it does not unlawfully infringe another person’s privacy, intellectual-property, contractual, or other rights; and
  • it does not contain malicious code or unlawful material.

You grant WA MAC a nonexclusive, royalty-free right to use, reproduce, transmit, store, adapt, and disclose the User Submission only as reasonably necessary to respond to you, evaluate or provide requested services, administer a property or relationship, operate and protect the Website, comply with law, or exercise legal rights. This permission continues for as long as reasonably necessary for those purposes.

Do not send Social Security numbers, complete financial-account numbers, passwords, access codes, or similarly sensitive information through an ordinary Website contact form, email, or text message unless WA MAC expressly designates that method for the information.

10. Electronic Communications

When you provide contact information or communicate with WA MAC electronically, you consent to receive responsive and operational communications through the contact methods you provide, subject to applicable law. These may include inquiry responses, application updates, showing information, appointment reminders, maintenance coordination, payment notices, property notices, or other communications related to your request or existing relationship.

Your consent to receive promotional messages is governed by the consent presented when information is collected and applicable law. You may opt out of promotional email or text messages as described in our Privacy Policy or the message itself. Opting out of promotions does not prevent non-promotional communications that are reasonably necessary for an application, agreement, tenancy, payment, maintenance request, legal notice, safety matter, or existing service relationship.

Electronic communications may not always be secure or delivered without delay. Do not use the Website, email, or ordinary text messages to report an emergency.

11. No Emergency Service Through the Website

The Website and its contact forms are not monitored continuously and must not be relied upon for fire, gas leaks, active flooding, medical events, crimes in progress, immediate threats, or other emergencies.

For an immediate threat to life or safety, call 911 or the appropriate emergency authority. Tenants and occupants should also follow the emergency procedures and maintenance-reporting instructions provided for their property. Submitting an online message does not establish that WA MAC has received or accepted responsibility for an emergency request.

12. Acceptable Use

You agree to use the Website only for lawful purposes and in accordance with these Terms. You may not:

  • provide materially false, fraudulent, misleading, or impersonated information;
  • use another person’s identity, credentials, payment information, or account without authorization;
  • attempt to gain unauthorized access to the Website, accounts, servers, networks, or data;
  • probe, scan, bypass, disable, or interfere with security or authentication features;
  • introduce malware, malicious code, automated attacks, or harmful material;
  • overload, disrupt, damage, or impair the Website or another person’s use of it;
  • scrape, crawl, harvest, index, copy, or extract Website content or data through automated means without written permission, except as permitted by applicable law;
  • use Website information to harass, discriminate against, defraud, or harm another person;
  • upload unlawful, defamatory, threatening, obscene, infringing, or privacy-invasive material;
  • remove copyright, trademark, attribution, or proprietary notices; or
  • use the Website or its content to compete with WA MAC, create a commercial database, or provide unauthorized commercial services.

WA MAC may investigate suspected misuse and may preserve or disclose relevant information as permitted by our Privacy Policy and applicable law.

13. Intellectual Property

The Website and its original content, design, arrangement, graphics, text, photographs, videos, logos, trademarks, service marks, software, and other materials are owned by WA MAC or used with permission and are protected by intellectual-property laws.

Subject to these Terms, WA MAC grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for your personal or internal business purpose of learning about, requesting, receiving, or administering WA MAC services or a property relationship.

You may not reproduce, publish, distribute, modify, create derivative works from, publicly display, sell, license, frame, mirror, or commercially exploit Website content without prior written permission from WA MAC or the applicable owner. No right in any WA MAC name, logo, trademark, or service mark is granted by implication.

14. Copyright Concerns

If you believe material on the Website infringes a copyright you own or are authorized to enforce, send a written notice to contact@wa-mac.com containing:

  • identification of the copyrighted work;
  • identification and location of the allegedly infringing Website material;
  • your name and contact information;
  • a statement that you have a good-faith belief the disputed use is not authorized by the copyright owner, its agent, or law;
  • a statement that the notice is accurate and that you are the owner or authorized to act for the owner; and
  • your physical or electronic signature.

WA MAC may request additional information, remove or restrict access to material, or forward the notice to the person who supplied the material. This section does not designate WA MAC as a registered Digital Millennium Copyright Act agent or create obligations beyond applicable law.

15. Third-Party Websites, Services, and Content

The Website may link to or display content from third-party property platforms, maps, payment processors, application or screening providers, electronic-signature services, vendors, social-media services, government agencies, or other websites. Links are provided for convenience and do not necessarily constitute endorsement.

WA MAC does not control and is not responsible for the availability, accuracy, security, accessibility, terms, privacy practices, products, services, or content of independent third parties. Your dealings with a third party are between you and that third party. Review the third party’s terms and privacy notice before using its service or providing information.

16. Privacy

WA MAC’s collection, use, disclosure, protection, and retention of personal information are described in our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference for purposes of explaining our information practices, but it is not intended to convert the Privacy Policy into a promise beyond applicable law.

17. Website Availability and Changes

WA MAC may maintain, modify, restrict, suspend, or discontinue any part of the Website or any Website feature at any time. We do not guarantee that the Website, a listing, a portal link, or any content will always be available, uninterrupted, secure, complete, or error-free.

WA MAC may restrict access when reasonably necessary for maintenance, security, legal compliance, suspected misuse, protection of users or systems, or operational reasons. We are not responsible for delays or interruptions caused by internet or telecommunications failures, third-party platforms, maintenance, cyber events, weather, public emergencies, governmental action, or other circumstances outside our reasonable control.

18. No Professional Advice

Website content does not constitute legal, tax, accounting, financial, investment, insurance, engineering, architectural, environmental, code-compliance, home-inspection, or real-estate brokerage advice. WA MAC does not represent you in a legal or professional capacity merely because you use the Website or communicate with us.

Property owners, applicants, tenants, vendors, and other users should consult appropriately licensed professionals regarding their particular circumstances. No Website content should be used as a substitute for an inspection, professional evaluation, legal advice, or review of the actual agreement governing a property or service.

19. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WA MAC DISCLAIMS ALL WARRANTIES REGARDING THE WEBSITE AND WEBSITE CONTENT, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WA MAC DOES NOT WARRANT THAT THE WEBSITE OR CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; THAT THE WEBSITE OR ITS SERVERS WILL BE FREE OF HARMFUL COMPONENTS; OR THAT USE OF THE WEBSITE WILL PRODUCE A PARTICULAR RESULT.

THIS SECTION APPLIES ONLY TO THE WEBSITE AND WEBSITE CONTENT. WARRANTIES, IF ANY, CONCERNING PAID SERVICES, VENDOR WORK, MATERIALS, A PROPERTY, OR A TENANCY ARE GOVERNED BY THE APPLICABLE SERVICE AGREEMENT, LEASE, WARRANTY, OR LAW.

Some jurisdictions do not allow the exclusion of certain warranties, so portions of this section may not apply to you.

20. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WA MAC AND ITS OWNERS, OFFICERS, EMPLOYEES, REPRESENTATIVES, AND WEBSITE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE WEBSITE, WEBSITE CONTENT, OR THESE TERMS, INCLUDING LOSS OF DATA, LOSS OF USE, LOST PROFITS, LOST REVENUE, OR BUSINESS INTERRUPTION, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF WA MAC AND THE PARTIES IDENTIFIED ABOVE FOR ALL CLAIMS ARISING FROM OR RELATING TO THE WEBSITE, WEBSITE CONTENT, OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT, IF ANY, YOU PAID WA MAC SPECIFICALLY FOR ACCESS TO THE WEBSITE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not apply to liability that cannot lawfully be excluded or limited. Liability arising from property-management services, home-management services, a lease, paid work, or another contracted relationship is governed by the applicable Service Agreement and law, not this Website liability cap.

21. Indemnification for Website Misuse

To the extent permitted by law, you agree to indemnify and hold harmless WA MAC and its owners, officers, employees, and representatives from third-party claims, liabilities, damages, judgments, and reasonable costs arising directly from:

  • your unlawful or unauthorized use of the Website;
  • your material breach of Sections 9, 12, or 13 of these Terms;
  • a User Submission that unlawfully infringes or violates a third party’s rights; or
  • your fraud, willful misconduct, or misuse of another person’s account or information.

WA MAC will provide reasonable notice of a covered claim and may control its defense with counsel of its choosing. You agree to provide reasonable cooperation. This section does not require indemnification for a claim caused by WA MAC’s own negligence or wrongful conduct to the extent such indemnification is prohibited by law.

22. Suspension and Termination

WA MAC may suspend or terminate your access to the Website or a WA MAC-controlled Website account if we reasonably believe you violated these Terms, created a security or legal risk, used the Website fraudulently, or interfered with another person’s rights or use.

You may stop using the Website at any time. Termination of Website access does not terminate or modify a lease, Service Agreement, payment obligation, legal notice, or other separate relationship. Provisions that by their nature should survive termination—including intellectual-property provisions, disclaimers, limitations of liability, indemnification, and dispute provisions—will survive.

23. Governing Law and Venue

These Terms and disputes arising specifically from the Website or these Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law rules. Subject to any applicable law that requires otherwise, the state and federal courts located in Marion County, Indiana will have exclusive jurisdiction, and you consent to personal jurisdiction and venue in those courts.

This section does not replace an arbitration, venue, governing-law, or dispute-resolution provision contained in a lease, Service Agreement, or other agreement. The dispute provision in that governing document applies to disputes within its scope.

24. Changes to These Terms

WA MAC may revise these Terms to reflect changes to the Website, our practices, or applicable law. The “Last Updated” date identifies the latest revision. Revised Terms apply when posted unless a later date is stated.

When required by law or reasonably appropriate for a material change, WA MAC may provide additional notice. Your continued use of the Website after revised Terms become effective means you accept the revised Terms. Changes do not retroactively modify a separate Service Agreement or lease.

25. General Provisions

These Terms, together with the Privacy Policy and any additional Website terms presented for a particular feature, are the entire agreement concerning use of the Website. They do not replace a Service Agreement, lease, application criteria, payment authorization, screening disclosure, or other agreement governing a separate transaction or relationship.

If a court determines that a provision of these Terms is unenforceable, it will be enforced to the maximum extent permitted or severed, and the remaining provisions will continue in effect. WA MAC’s failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without WA MAC’s written consent. WA MAC may assign these Terms in connection with a merger, reorganization, transfer of the Website, or sale of relevant business assets.

Headings are for convenience only. The words “including” and “includes” mean “including without limitation.” Electronic versions of these Terms and notices provided electronically are admissible to the same extent as business records originally generated and maintained in printed form, subject to applicable law.
